Gideon’s Trumpet
In Gideon’s Trumpet, a 51-year-old white man from the South argues that he was denied due process of law during his 1961 trial. In this landmark case, Gideon v. Wainwright, the judge rules that a white man’s right to counsel should automatically apply to cases involving a non-capital felony. The case also raises important legal questions about the meaning and concept of the Due Process Clause and the Equal Protection Clause. In fact, the case set the stage for modern interpretations of the Fifth and Sixth Amendments.
The case was a turning point in American justice, and the decision was a classic. States fought over whether to require all defendants to have legal counsel. Gideon was granted a new trial because he refused assistance from an attorney from out-of-state, and instead was assigned a local lawyer. He won his freedom and a new trial, which changed the rules of the justice system.
Though the Gideon decision failed to live up to its promise, some in the academy are questioning the traditional liberal view of Gideon’s Trumpet. One law professor at the University of San Diego, Donald A. Dripps, for example, argues that Gideon’s Trumpet has become both a failure and a paradox, because it has failed to deliver effective representation for the typical indigent defendant.
